01About these terms

These Terms and Conditions ("Terms") govern your use of www.executive-panel.com (the "Website") and any purchase, booking, or service you request through it. The Website is owned and operated by Thee Executive-Panel, LLC, doing business as The Executive-Panel ("The Executive-Panel," "we," "us," or "our").

By using the Website, booking an appointment, or making a purchase, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Website.

In these Terms, "you" and "your" mean the person using the Website and, where you act on behalf of an organization, that organization.

02Our services

The Executive-Panel provides executive and leadership coaching, leadership development, succession planning, culture transformation, leadership assessments, and resume, interview preparation, and career services.

The information on the Website describes our services in general terms. Ongoing coaching, consulting, and organizational engagements are governed by a separate written agreement or proposal. If that agreement conflicts with these Terms, the agreement controls for that engagement.

03Appointments and scheduling

Appointments are booked through a third-party scheduling service. Free consultations are offered at our discretion and do not create a coaching or advisory relationship.

Paid sessions are billed at the rates shown at the time of booking or in your agreement. If you need to reschedule or cancel, please give as much notice as possible. Any specific cancellation or rescheduling terms are shown when you book or in your agreement.

04Purchases, pricing, and payment

Prices are listed in U.S. dollars and may change at any time. Changes do not affect orders already placed. Applicable taxes are added at checkout.

Hourly services, such as Executive Coaching and Resume and Career Services, are purchased by the hour. The quantity you select is the number of hours purchased. Payments are processed securely by our e-commerce and payment providers; we do not store your full card details.

Delivery times listed for assessments and reports are estimates and depend on third-party providers and, for 360-degree assessments, on rater participation.

05Refunds

Because assessment licenses are purchased from third-party providers on your behalf, assessment purchases are non-refundable once your assessment link has been issued. Refunds for unused hours or other services are handled under your agreement or, if there is none, at our reasonable discretion. To request a refund, email admin@executive-panel.com.

06Third-party assessments and trademarks

Some assessments we offer are owned and administered by third parties. Your use of those assessments may also be subject to the provider's own terms. We are not the owner of these assessments, and their use on this Website does not imply endorsement by their owners.

07Not professional advice

Coaching, assessments, and career services are designed to support your professional development. They are not psychotherapy, counseling, or medical care, and they are not legal, financial, tax, or investment advice. You remain responsible for your own decisions and their results. If you need professional advice in any of these areas, please consult a qualified professional.

08No guaranteed results

We cannot guarantee any particular outcome, including a promotion, interview, job offer, compensation level, or business result. Testimonials on the Website reflect the individual experiences of the people who wrote them. Your results will depend on many factors outside our control.

09Confidentiality

We treat what you share in coaching and career work as confidential, subject to the terms of your agreement, our Privacy Policy, and any disclosure required by law. Client examples on the Website are anonymized, and sample resumes are fictional.

10Intellectual property

Unless otherwise stated, The Executive-Panel and its licensors own all content on the Website, including text, graphics, logos, frameworks, and sample materials. You may view and print pages for your own personal, non-commercial use. You may not republish, sell, rent, sublicense, reproduce, or redistribute Website content without our written permission.

Once paid in full, resumes, profiles, and other materials we create for you are yours to use for your own career purposes. We may retain copies for our records. We will not publish your materials or identify you as a client without your permission.

11Acceptable use

You agree not to use the Website in any way that is unlawful, harmful, or fraudulent; that interferes with the Website's operation or security; or that infringes anyone's rights. You also agree not to attempt to gain unauthorized access to any part of the Website or its systems.

12Linking to our Website

You may link to our home page or other public pages, as long as the link is not misleading, does not suggest that we sponsor or endorse you, and fits the context of your site. You may not frame our pages or alter how they appear, and you may not use our logo or other artwork without our written permission. The Website uses and links to third-party services, including our website host, scheduling, payment, and assessment providers, and social media sites. We are not responsible for their content, policies, or availability. Your use of those services is subject to their own terms.

We work to keep the Website accurate and available, but it is provided "as is" and "as available." To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement, and we do not promise that the Website will be uninterrupted or error-free.

15Limitation of liability

To the fullest extent permitted by law, The Executive-Panel will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or opportunity, arising from your use of the Website or our services. Our total liability for any claim relating to the Website or our services will not exceed the amount you paid us in the twelve months before the claim arose.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud.

20General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with our Privacy Policy and any written agreement with you, are the entire agreement between you and us regarding the Website.
